Grant County to Vote on Data Center<\/strong> Moratorium Ordinance and More Updates<\/strong><\/p>\n\n\n\n

On Thursday, the Grant County Commission approved a notice of intent<\/a> to consider a one-year moratorium for data centers. Brought forth by Commissioner Nancy Stephens in response to the Site Layer 1 Data Center proposal noticed in the Silver City Daily Press<\/a> at the end of August, this temporary pause will allow the Commission to gather information from independent experts on the pros and cons of adopting county regulations for data centers. The vote on the ordinance itself<\/a> will take place at the Commission’s regular meeting on October 22.<\/p>\n\n\n\n

The NM Environment Department made public last week Secretary James Kenney’s letter<\/a> to the Site Layer 1 Data Center proponents, Granite Renewables, in which he told them that any air quality permit application would be deemed incomplete until the company carried out a sufficient public engagement process. Kenney wrote: “It is entirely your [Granite Renewables’] job to seek a social license to operate in the local community by engaging community members and addressing their concerns prior to your permit hearing. A permit hearing is an opportunity for public participation, but it is well past the opportunity for Site Layer 1, LLC to earn the community\u2019s trust and support.” Site Layer 1’s public notice notifies the Grant County community that it will submit an air quality permit on October 1.<\/p>\n\n\n\n

To date, the company has not informed Grant County commissioners and other officials about its data center project. The secrecy from Site Layer 1 proponents gives credence to efforts to institute a data center moratorium like those being advocated in Grant County, other affected communities in New Mexico, and at the state level.<\/p>\n\n\n\n

Private equity is funding Site Layer 1. Corner<\/a>, a multi-billion-dollar investment firm that backs, builds, and operates companies across the AI economy. The address included in the legal notice of Site Layer 1 was the same empty New York City building floor shown for Corner on their LinkedIn page. Since then, all addresses for Corner offices have been removed from LinkedIn. However, the SEC filings for Corner Capital Management show the same address for the empty Manhattan office as Site Layer 1.<\/p>\n\n\n\n

State business registrations for Site Layer 1 LLC (Grant Co. New Mexico), Site Layer 2 LLC (Logan Co. Colorado) and Site Layer 4 LLC (Platte Co. Wyoming) all show David Katz, Director of Legal for Corner, as the authorizing individual. <\/p>\n\n\n\n

The Marcus brothers, Ian and Blake, appear to be \u201cfront men\u201d for Corner operating as Granite Renewables also based in New York City. According to their website, they \u201cdevelop project sites for co-located data centers\u201d. They are documented as being publicly involved in Site Layer projects 1,2, & 4. Granite Renewables is also the addressee of the letter from NMED Secretary James Kenney demanding public engagement before the Site Layer 1 air quality permit can move forward.<\/p>\n\n\n\n
